Oscar Pistorius was convicted of criminal negligence in the 2013 after the Olympic champion shot his late girlfriend, Reeva Steenkamp and claimed he thought she was an intruder.
Pistorius was originally charged with first degree murder but the double amputee was acquitted of the charge but was later sentenced to five years in prison by judge Masipa. The prosecution were however given the right to appeal the decision and they have exercised that right. According to the prosecution, Judge Masipa did not interpret the law correctly, stating that in South African law, if the accused knows an action might kill someone and he/she goes ahead and takes that action, he/she is guilty of second degree murder. The prosecution lawyers are now set to appear before judge Masipa on the 13th of March as they want the culpable homicide charge overturned
Pistorius who is currently serving his five year sentence made history in 2012 when he became the first amputee to compete at the Olympic games
